Traceora

Terms of Service

These Terms govern your use of Traceora, a personal symptom, lifestyle, and pattern-journaling app. Traceora is not a medical device, healthcare provider, diagnosis tool, treatment tool, or emergency service.

1. Who We Are

Traceora is published by Veybyte Labs and operated by Nexoria Labs LLC, registered in Wyoming, USA. For app support, contact [email protected]. For legal questions, contact [email protected].

2. Acceptance of These Terms

By creating an account, accessing, or using Traceora, you agree to these Terms, the Traceora Privacy Policy, and the Traceora Health Data Consent. If you do not agree, do not use the app. If you use Traceora on behalf of another person, you confirm that you have legal authority to do so.

3. Eligibility

Traceora is intended for users who are at least 13 years old, or older if your country requires a higher minimum age for digital services or health-related data consent. You may not use Traceora if you are barred from using the service under applicable law or if we previously suspended or terminated your account for security, abuse, or legal reasons.

4. What Traceora Does

Traceora lets you log symptoms, severity ratings, lifestyle variables, notes, dates, times, optional device health or activity data, and generated pattern summaries based on your own entries. The app is designed for personal journaling, self-observation, and exporting your own records. It is not designed to replace medical care or professional judgment.

5. Not Medical Advice, Diagnosis, or Treatment

Traceora does not provide medical advice, clinical advice, diagnosis, treatment, cure, mitigation, or prevention of any disease, condition, or symptom. Traceora does not monitor you for emergencies and does not contact emergency services. Pattern summaries, charts, correlations, AI-assisted wording, and other outputs are informational descriptions of data you logged and may be wrong, incomplete, delayed, or misleading.

Always consult a qualified healthcare professional for medical questions, new or worsening symptoms, medication decisions, diagnosis, treatment, pregnancy-related concerns, mental health crises, or urgent health decisions. If you may be experiencing a medical emergency, contact emergency services immediately.

6. Your Entries and Decisions

You are responsible for the information you enter, import, review, export, or share from Traceora. You are responsible for decisions you make based on your data or app outputs. You agree not to rely on Traceora as the sole basis for medical, safety, legal, financial, employment, insurance, or emergency decisions.

7. Health Data Consent

Because Traceora stores health-related journaling information, you must review and accept the Health Data Consent before using the app. You consent to our processing of health-related information you choose to enter or import for the purposes described in the Privacy Policy and Health Data Consent. You may withdraw consent by deleting your account or contacting support, but withdrawal may require account deletion because the app cannot operate without processing your health-related logs.

8. Account Security

You are responsible for keeping your email, password, devices, and app access secure. Notify us promptly if you believe your account or device has been compromised. We may require password resets, revoke sessions, suspend accounts, or restrict features to protect users, the service, or legal compliance.

9. Acceptable Use

You must not misuse Traceora, attempt unauthorized access, probe or bypass security controls, scrape or overload systems, reverse engineer protected parts of the service except where law permits, submit unlawful or harmful content, impersonate others, abuse support channels, violate others' rights, or use Traceora in a way that interferes with users, providers, app stores, or infrastructure.

10. AI and Pattern Insights

Traceora may use automated statistical methods and AI-assisted services to turn patterns in your logged data into plain-language summaries. These outputs are not reviewed by a doctor, are not medical conclusions, and may reflect correlation rather than causation. You must independently verify any information before acting on it and consult qualified professionals for health decisions.

11. Optional Device Health Imports

If you enable optional device health imports, Traceora may read selected health, sleep, activity, or fitness data that you authorize through your device or platform settings. You can disable those permissions through your device settings. Data imported before permissions are disabled may remain in your account until you delete it or delete your account, subject to backup and legal retention limits.

12. Third-Party Services and App Stores

Traceora depends on third-party providers for authentication, database storage, backend hosting, email, AI-assisted wording, mobile operating systems, app stores, and other infrastructure. Their services may be unavailable, delayed, changed, or subject to their own terms and policies. App store providers are not responsible for Traceora except as required by their own rules or applicable law.

13. Ads and Monetization

Traceora may show optional ads in the free version of the app. Ads must not be interpreted as medical advice, endorsement, diagnosis, treatment, or a recommendation from Traceora. We use contextual or non-personalized ads and do not allow health-related app data to be used for personalized ad targeting. Paid, subscription, or ad-free features may be added later and may be subject to app store terms and any additional terms shown at purchase.

14. Account Deletion and Data Export

You may delete your account in the app. Account deletion is intended to permanently remove your account and app data from active systems, subject to limited backup, security, fraud-prevention, legal, dispute, accounting, and operational retention. Available export features are provided for convenience and may not include every internal system record, log, or backup copy.

15. Ownership and Limited License

Traceora, including its software, design, text, branding, features, and related materials, is owned by Nexoria Labs LLC or its licensors. We grant you a personal, limited, revocable, non-exclusive, non-transferable license to use Traceora for your own lawful personal use, subject to these Terms.

16. Your Content

You keep ownership of the information you enter into Traceora. You grant us a limited right to host, store, process, transmit, display, analyze, back up, and secure that information only as needed to operate, support, protect, and improve Traceora and comply with law. You represent that you have the right to enter or import the information you provide.

17. Changes, Availability, and Beta Features

We may update, change, suspend, limit, or discontinue any part of Traceora for security, reliability, legal compliance, provider limitations, platform requirements, or product improvement. Some features may be experimental, incomplete, or unavailable in your region. We do not guarantee uninterrupted service or that every feature will remain available.

18. Disclaimers

To the maximum extent permitted by law, Traceora is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, availability, non-infringement, or that outputs will be complete, reliable, or suitable for your needs.

19. Limitation of Liability

To the maximum extent permitted by law, Nexoria Labs LLC, Veybyte Labs, and their owners, officers, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, punitive, health-related, data-loss, lost-profit, business-interruption, or reliance damages arising from or related to Traceora. Where liability cannot be excluded, our aggregate liability will be limited to the greater of the amount you paid for Traceora in the six months before the claim or USD $100, unless applicable law requires more.

20. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Nexoria Labs LLC, Veybyte Labs, and their owners, officers, employees, contractors, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from your misuse of Traceora, your violation of these Terms, your violation of law, or information you submit without proper rights or authorization.

21. Governing Law and Disputes

These Terms are governed by the laws of Wyoming, USA, without regard to conflict-of-law rules, except where consumer protection laws in your place of residence require otherwise. Before filing a claim, you agree to contact us at [email protected] and try to resolve the issue informally. Nothing in these Terms limits rights that cannot be waived under applicable law.

22. Updates to These Terms

We may update these Terms as Traceora, providers, laws, or platform requirements change. Material changes may require you to review and accept updated terms in the app. Continued use after an update means you accept the updated Terms.
